Terms of service

Who we are and accepting these terms

CityLens is a building data platform for New York City and Westchester County, run by AoRa Development LLC ("we", "us"). These terms are an agreement between us and you, or the company you use CityLens for. By creating an account, using CityLens or calling its API, you accept these terms. If you accept them for a company, you confirm that you can bind it. If you do not accept them, do not use CityLens.

Your account

  • You must be at least 18 and give us accurate sign-up details.
  • Keep your sign-in secure. You are responsible for what happens under your account and your API keys.
  • Tell us promptly if you think someone has used your account without permission.
  • One person per account. Do not share your sign-in or API keys outside your organization.

Acceptable use

You may use CityLens for your own business purposes. You must not:

  • scrape, crawl or bulk download CityLens, or call the API beyond the limits of your plan;
  • resell, sublicense or republish raw CityLens data, or use it to build a competing data product;
  • use owner names or contact details for unlawful marketing, for harassment, or to call or text any number on the national Do Not Call registry or otherwise break telemarketing, anti-spam or privacy laws;
  • use CityLens to decide anyone's eligibility for credit, insurance, housing or employment;
  • get around request limits, paywalls or security, or access another customer's data;
  • upload malicious code or disrupt the service; or
  • break any law while using CityLens.

Data accuracy

CityLens combines public records, licensed data and our own models. Much of what it shows is an estimate, including Local Law 97 emissions, fines and penalties, energy use, retrofit costs, incentive amounts, ownership links and climate risk scores. Source records can be wrong, late or incomplete, and our models can be wrong. CityLens is information, not legal, financial, tax, engineering or investment advice. Check anything you rely on with the source agency or a qualified professional before you act on it.

Our property and yours

CityLens, its software, design, models and the way it compiles data belong to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use CityLens under these terms while your account is active. Public records stay public; these terms do not claim them. You keep what you upload or enter, such as watchlists and portfolios, and you let us use it to run CityLens for you. If you send us feedback, we may use it freely.

API terms

  • Keep your API keys secret and use them only for your own account.
  • Each plan has request limits. When you reach a limit, requests are refused until it resets. We may change limits to protect the service, and will tell you before a lasting reduction on a paid plan.
  • Do not cache or store API results beyond what your own product needs, and do not expose them to the public in bulk.
  • Show that data comes from CityLens where you display it to others.
  • We may change or retire API versions, with reasonable notice for paid plans.

Fees, renewal and cancellation

Paid plans are billed in advance through Stripe, monthly or yearly, and renew automatically until you cancel. Prices are shown before you subscribe and exclude taxes, which you pay. You can cancel at any time from Billing and plan in your account; your plan stays active until the end of the period you have paid for. We do not refund partial periods unless the law requires it. We will tell you at least 30 days before a price change applies to your plan.

Suspension and termination

You can stop using CityLens and delete your account at any time. We may suspend or end your access if you break these terms, do not pay, or put the service or other people at risk. Where we reasonably can, we will warn you first and give you a chance to fix the problem. When your access ends, your right to use CityLens ends too. The sections on data accuracy, our property, disclaimers, limits on liability, indemnity and governing law still apply.

Disclaimers

CityLens is provided "as is" and "as available". To the extent the law allows, we make no promises that it will be accurate, complete, uninterrupted or fit for a particular purpose, and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Limits on our liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from CityLens or these terms. Our total liability for any claim is limited to the fees you paid us for CityLens in the 12 months before the claim arose, or 100 US dollars if you paid nothing. These limits do not apply where the law does not allow them.

Indemnity

You will defend and compensate us for claims, losses and costs, including reasonable legal fees, that arise from your breach of these terms, your misuse of CityLens data, including any calls or messages you send to property owners, or your breach of the law.

Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute will be heard in the state or federal courts located in New York, and both of us agree to those courts' jurisdiction.

Changes to these terms

We may update these terms. If a change is material, we will tell you at least 30 days before it takes effect, by email or in CityLens. If you keep using CityLens after a change takes effect, you accept it. If you do not accept it, you can cancel before then.

General

These terms, with our privacy notice and any order form you sign with us, are the whole agreement about CityLens. If part of them cannot be enforced, the rest still applies. Not enforcing a term is not a waiver of it. You may not transfer these terms without our consent; we may transfer them with our business.
